Replacement Guarantee, Refunds and Limitations

If the employment relationship between Client and Caregiver terminates due to irreconcilable differences within the first ninety (90) calendar days of the Caregiver’s start date, Agency will provide a one-time replacement for 50% of the Authorized Representation Service Fee, ($200).  Client will also be required to pay for the replacement Caregiver’s transportation costs in accordance with the Live-in Caregiver Program requirements.

If Client selected the Overseas Caregiver Referral Service, Client may request Agency to make an effort to find a replacement Caregiver under the Live-in Caregiver Program who is already located in Canada for an additional service fee of $200.

Alternatively, Agency will refund the Caregiver Referral Fee (value of $999 for overseas referral or $1,199 for local referral).

If the Caregiver selected by Client is denied a work permit due to deficiencies related to the Caregiver, Agency will provide a replacement Caregiver at no additional charge.  Alternatively, Agency will refund all of the service fees except for the Authorized Representation Fee valued at $400.

Limitations

Agency will not provide a replacement guarantee or refund under the following conditions:

(a)    Client breaches any part of the Agreement;

(b)    The employment relationship between Client and Caregiver terminates under violation or suspicion of: misrepresentation of the employment contract, Caregiver mistreatment, breach of criminal, civil or employment law;

(c)    Failing to notify Agency of employment conflicts prior to dismissing Caregiver with cause so that an effort towards resolution may be made.

(d)    Client’s deficiency in meeting the requirements of the Live-in Caregiver Program as outlined by HRSDC and CIC;

(e)    Failing to provide Caregiver with a detailed job description; or

(f)     Failing to take reasonable action to develop a relationship with the Caregiver during work permit processing.

Note: Refund and guarantee policies are subject to individual Client and Agency agreements agreed to in writing.
